This is a non-profit organisation and convention. All monies, after coverage of convention costs, will be donated to non-profit organisations. Our accounting is solid and checked by two teams to ensure transparency and that all money is applied directly to the event and any overage, to non-profit organisations. The X-Con Germany is an association which engages itself with “The X-Files” (TV series, movies, spin-offs) and was founded for the realization of the X-Con in Berlin. This convention is in association with “The X-Files” to promote the new Complete Box Set (German edition). General Terms
§1 Validity
1.1 On purchase of the entrance ticket the visitor recognizes these General Terms.
1.2 These General Terms are valid on effect of 1 April 2009. There is no limitation. Possible previous General Terms lose effect with this release.
1.3 Verbal agreements which are in contrary of one or more regulations within these General Terms and have not been confirmed again in written form are not valid.
§2 Contract
2.1 By effecting payment of the entrance fee, a contract is concluded between the organizer and the visitor.
2.2 The organizer reserves amendments in kind and way of course of the planned programme.
2.3 The organizer reserves amendments in the kind of the event. Amendments will be announced in time accordingly. In case the visitor does not agree he has got the right to withdraw from the contract and demand a reimbursement of the paid entrance fee. The withdrawal must be placed in written form -either electronically or by post service- and must be effected instantly after having received according announcement.
2.4 The organizer does not guarantee the appearance of a certain guest star, however, will strive for a substitute in case one or more of the guest stars withdraw from the contract or cannot appear. The right to withdraw from the contract is not given to the visitor in case of such an event.2.5 Programme issues will be partially held in English, the organizer will not provide a translation. Foreign visitors have to assume, that the same way there are programme issues held in German where no translation service will be provided either. However, the organizer is endeavored to do so. The right to withdraw from the contract is not given to the visitor because of this.
2.6 In case of cancellation of the event the organizer reimburses the paid entrance fee within 4 weeks. The organizer does not compensate any other costs like flights or booked hotel rooms etc. This has to be done self-responsibly.
2.7 In case the visitor cannot attend the event for a reason, he can confer the ticket to someone else. Then the visitor has to submit all necessary data of the person who takes over the ticket. It is forbidden to sell the ticket for a higher amount than originally paid.
2.8 On postponing (in terms of time and/or location) of the event the same conditions as stated with 2.3 apply.
2.9 It is planned that each visitor receives at least one autograph which is included in the entrance fee.
However, this is not automatically a guarantee and can therefore not be demanded or complained about.
2.10 It is mandatory that the visitor carries his/her valid ID card (from outside the EU passport and juveniles according document) as well as the registration confirmation. If this fails to be done there cannot be granted access to the area.
§3 Liability
3.1 The visitor attends the event at own risk.
3.2 The organizer cannot be hold liable for personal injuries the loss of personal items. Every visitor has to take of him/herself and of his/her belongings. 3.3 Juveniles have got no access to accordingly marked rooms. Juvenils until the age of 14 have to be chaperoned by a legal guardian or authorized person. Juveniles aged 15 to 17 are allowed to attend unchaperoned if the legal guardian provides a written declaration of approval which also allows the juvenile visitor to be independent. Refering to this the separate registration forms have to be noted. The declaration of approval has to be enclosed with the registration confirmation and be available prior of the event taking place. On attendance of the event without a registration in advance, the according declaration have to be presented. In case that fails to happen, no access will be granted to the juvenile visitor. Juveniles aged 10 and less are free, no entrance fee has to be paid.
3.4 During the event there will be the possibility of daycare for children. It is hereby strongly drawn attention to the following:The legal guardian (or parents together) has to agree that the child/children may be supervised in the X-Con daycare. Furthermore he/she has to confirm that he/she still has to meet his/her responsibility by regularly looking after his/her child/children. With the signature he/she declares that he/she is aware of the fact that his/her child/children will be permanently supervised at the daycare room provided throughout the convention hours by voluntary personnel. However, he/she has to be permanently available.On location, there will be a system/document available which ensures that each child can only be handed over by/handed back to the person who was stated in advance. The legal guardian obliges him/herself particularly to notifies the organizer in advance about any special information needed for the care of the child/children (e.g. diabetes, illnesses, allergies).The organizer cannot be hold liable for claims for compensation which are found on the kind, planning, organisation, supervision or conduction of the event, unless the organizer commits an act of culpable negligence.
3.5 The organizer can only be hold liable for intention and gross negligence.
3.6 The visitor can be hold fully liable for damages caused by him to third parties (including the location of the event and the organizer).
3.7 The organizer cannot be hold liable for damages to visitors caused by third parties which were instructed by the organizer.
3.8 The organizer cannot be hold liable for discrepancies or such between him/her and the mediated hotel. Claims of these parties can only be asserted to those parties.
3.9 Disclaimer for the Internet Presence
3.9.1 Website Content The X-Con Germany is responsible for all website content and its authors take care to provide complete, accurate and updated information to the best of their ability. Liability claims against site authors caused by improper use of information or disinformation are rejected and any errors are unintended and are not the cause of wanton neglect. As such, no fault shall be given. All offers are non-binding and without obligation. Website authors expressly reserve the right to change in part or in whole, all site related content with or without official announcement.
3.9.2 References and LinksAll direct or indirect references and links to external websites are outside of the responsibility of the X-Con Germany authors. 3.10 Visitors/Staff members who provide own possession are responsible themselves for these item. The organizer cannot guarantee its integrity, however, strives for it by the instructed personnel in the best way possible. Claims of comoensation can be asserted if the organizer acts with intention or gross negligence. In other cases, the person who caused tha damage is to be held liable.
§4 Law and Order
4.1 All instructions given by Con staff members, stewards and security personnel are to be obeyed by all attendees. In the event a visitor is behaving in a way that could endanger others, we reserve the right to expel this person from the event without refund.
4.2 Upon loss of the entrance ticket there is no right no more to access the event location.
4.3 Weapons, weapon-like objects, objects resembling a weapon or pyrotechnic objects (such as fireworks) are strictly prohibited. This also include costume parts. Anyone caught with prohibited objects will have to surrender the object and especially refusal to do so will result in immediate expulsion from the convention and possible report to respective authorities.
4.4 Animals, glass objects (such as bottles), any kind of narcotics and drugs (of course except legally allowed amounts of pain killers for instance) and alcohol are not permitted! 4.5 Con staff members, stewards and security personnel is entitled to conduct random checks during the event.
§5 Records
5.1 Basically, taking photographs is allowed. However, it can be prohibited in certain rooms or during certain times. These will be announced accordingly.
5.2 Audio visual or visual records (films) are allowed. However, it can be prohibited in certain rooms or during certain times. Failing to obey these restrictions and those stipulated under 5.1 can result in being expelled from the event. All media dates have to be erased instantly infront of a staff member. Furthermore, the storage media has to undergo a programm on location which shredders all media on the data medium in order to prevent later reconstruction.
5.3 Audio records are obliged to the same conditions as in 5.2
5.4 Usage of recorded material for economic or commercial reasons is only allowed when given the written approval by the organizer.
5.5 Upon registration you agree on the fact that there might be taken video, photo and/or sound material
of the visitor.
§6 Miscellaneous
6.1 Upon accepting the General Terms, the visitor relinquishes on his right to take legal steps -now or in future- against the validity of these General Terms.
6.2 In case one of the previous stated agreements are non-effective, it does not touch the effectivity of the whole General Terms. There has to be found another corresponding formulation. In case single conditions of this contract are non-effective or not feasible, the rest of the contract remains effective. Instead of the non-effective or non-feasible conditions, those who are effective and feasible regulation takes over with which the objective target can be achieved the closest in the way the contract parties meant it to be by the non-effective respectively non-feasible conditions. The previous stated conditions are accordingly valid in case the contract is proven to be incomplete.
